Consultations are referred to in arts.4,6,7,17,18,19,24,26&30, and require a dialogue among participants without an obligation of reasonable compromise, or therefore of result. Art.17 refers to a special situation where a notification relates to possible infractions of the principle of equitable distribution or the duty not to cause transboundary damage. Art.17(2) then draws a distinction between consultation and negotiation by noting that the notifying state “…shall enter into consultations and if necessary, negotiations with a view to arriving at an equitable resolution of the situation.”
